Change Order Guidelines 

Applicability of the Revised Construction Contract Change Order Manual

The following rules apply to the effective date of applicability of the changes contained within this Manual:

1. Manual changes are not applicable to Risk Reallocation and Change Orders negotiated to written settlement prior to September 1, 2023. 
2. Manual changes are applicable to Contractor change Cost Proposals originally submitted after September 1, 2023, for a forward-priced contract change action. 
3. Manual changes will be applicable to portions of T & M work performed after September 1, 2023, when pursuant to a written Work Directive Letter. 
4. Manual changes may be applicable at the discretion of the Project Manager to Contractor Cost Proposals that are resubmitted after September 1, 2023, at the express request of the MBTA and due solely to additional changes in the scope of work.
